Terms of Service

These Terms govern your use of the Tolvane desktop application, the website at www.tolvane.ai and related services (together, the "Service"), provided by Code Crafted Nexus LLC, 160 Harris St, Grand Rivers, KY 42045, United States ("Code Crafted Nexus", "we", "us"). By installing or using the Service you agree to these Terms. If you do not agree, do not use it.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Tolvane on computers you own or control, for your own lawful use. You may not copy, modify, reverse engineer, decompile, resell, sublicense or redistribute the software, except where applicable law allows it despite this restriction.

2. Accounts

You need an account to use credits and rendering features. You are responsible for your account credentials and for activity under your account. You must provide accurate information and be at least 18 years old, or the age of majority where you live.

3. Credits and payments

• Some actions use credits. The cost of each action is shown in the app before it runs, and may be changed from time to time.
• Credits are purchased as one-time packs or through a monthly plan. They have no cash value and cannot be transferred or redeemed for money, except as required by law or the Refund Policy.
• If a generation fails on our side, the credits for that action are returned to your balance.
• Payments are processed by Paddle.com Market Limited and its affiliates, which act as the merchant of record. Paddle's terms apply to the purchase, and Paddle handles taxes, invoices and payment data.
• Monthly plans renew automatically until cancelled. You can cancel at any time and the plan continues until the end of the paid period.

4. Your content and the music you create

You keep the rights you have in anything you provide to the Service, including lyrics, prompts, reference audio and images ("Inputs"). You grant us the limited permission needed to process Inputs and deliver the results to you, including sending them to the third-party providers described in the Privacy Policy.

As between you and us, and to the extent we hold any rights, we give you the right to use the audio and images the Service generates for you ("Outputs") for personal and commercial purposes, subject to these Terms, the Acceptable Use policy, and the terms of our underlying technology providers. You are responsible for how you use and distribute Outputs.

5. Third-party services

The Service relies on third-party providers for music generation, language models, authentication, storage and payments. Their availability and terms can affect the Service. We are not responsible for third-party services outside our control.

6. Updates

The app can check for and install updates. Updates are downloaded only after you choose to install them. We may change, suspend or discontinue features at any time.

7. Suspension and termination

We may suspend or end your access if you break these Terms or the Acceptable Use policy, or if required by law. You can stop using the Service and delete your account at any time. Sections that by nature should survive termination will do so.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant the quality, originality or legal status of any Output.

9. Limitation of liability

To the maximum extent permitted by law, Code Crafted Nexus will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose.

10. Indemnity

You agree to defend and indemnify us against claims arising from your Inputs, your use of Outputs, or your breach of these Terms, to the extent permitted by law.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-law rules. Courts located in Kentucky have jurisdiction, unless mandatory consumer law where you live says otherwise.

12. Changes

We may update these Terms. If a change is material we will tell you in the app or by email. Continuing to use the Service after a change means you accept it.

Privacy Policy

This policy explains what Code Crafted Nexus LLC collects when you use Tolvane and why. We collect only what the Service needs.

What we collect

• Account data: your email address and sign-in details, handled by our authentication provider.
• Credit and billing records: your credit balance, purchases and usage history. Payment card details are collected by Paddle, not by us.
• Content you send for generation: prompts, chat messages with the producer, lyrics, and any reference audio or images you choose to use. This is sent to our service and providers when you request a chat reply or render.
• Generated files: audio produced by a render may be stored temporarily on our servers so you can download it and so features such as redo, reference and stem splitting can work.
• Technical data: app version, basic diagnostics and update checks. Your IP address is visible to our servers and providers when the app connects.
• Website data: messages you send us by email, and the technical data any web server receives.

What stays on your computer

Your library of songs, projects and covers is stored locally on your device. We do not receive it unless you send it to a feature that needs it.

How we use it

To provide and secure the Service, process payments and credits, give support, prevent abuse and fraud, meet legal obligations, and improve the product. We do not sell your personal information and we do not use your content to advertise to you.

Who we share it with

• Paddle (payments, taxes, invoices; merchant of record).
• Supabase (account, database and file storage hosting).
• ElevenLabs (music generation, stem separation and related audio processing).
• Anthropic (language model that powers the producer chat).
• Image generation provider (cover art, only when you use that feature).
• Email delivery provider (account and support emails).
• Authorities or advisers where the law requires it, or to protect rights and safety.

These providers process data on our behalf under their own terms and privacy policies. Content you send for generation is subject to their handling as well as ours.

Retention

We keep account and billing records while your account is active and as long as the law requires. Generated audio stored on our servers is kept only as long as needed to deliver and support the features above, and may be deleted afterward. You can ask us to delete your account and associated data at any time.

Your rights

Depending on where you live, you may have the right to access, correct, delete or export your data, to object to or restrict processing, and to complain to a data protection authority. Email support@tolvane.ai to make a request. We may need to verify your identity first.

Security

We use encryption in transit and access controls. No system is perfectly secure, and we cannot guarantee absolute security.

International transfers

We and our providers operate in the United States and other countries. Your data may be processed outside your country of residence.

Children

Tolvane is not directed to children under 13 (or the higher age required where you live), and we do not knowingly collect their data. If you believe a child has given us information, contact us and we will delete it.

Changes

We will post updates here and change the date above. For material changes we will notify you in the app or by email.

Refund Policy

We want you to be happy with Tolvane. Purchases are sold by Paddle.com, our merchant of record, and are covered by the following.

• 14-day money-back guarantee. If you are not satisfied, you can request a refund within 14 days of purchase.
• How to request. Use the link in your Paddle receipt, visit paddle.net, or email support@tolvane.ai with your order details and we will help.
• Used credits. Credits already spent on renders may be deducted from a refund where the guarantee is being abused. We will always consider genuine problems, such as a render that failed or did not work as described.
• Monthly plans. You can cancel at any time to stop future renewals. A refund for the current period can be requested within 14 days of the charge.
• Failed generations. If a render fails on our side, the credits are returned automatically and no refund is needed.
• Your statutory rights. Nothing here limits any rights you have under the consumer laws where you live.

Acceptable Use Policy

Tolvane is for making original music. When you use it you agree not to:

• Imitate the voice or likeness of a real person, or a specific artist, in a way that is misleading or without their permission.
• Upload reference audio, lyrics or images you do not have the right to use.
• Create content that is unlawful, defamatory, hateful, harassing, sexually exploitative of minors, or that promotes violence.
• Pass off AI-generated music as human-performed where disclosure is required by law or by a platform you publish on.
• Misuse the Service to spam, defraud or mislead, including mass-uploading generated tracks to streaming services.
• Attempt to bypass credit limits, share accounts to avoid payment, or abuse free credits or refunds.
• Probe, attack, reverse engineer or overload the Service or its providers.
• Use the Service to build or train a competing model.

Our providers may also block certain requests, such as prompts naming specific artists or copyrighted lyrics. If you believe something was blocked in error, contact support. We may remove content, suspend accounts or report unlawful activity where needed.

Cookies & Local Storage

This website uses no advertising or analytics cookies. It loads fonts from Google Fonts, which may receive your IP address, and it fetches the latest installer information from our storage service so that the download button is current. The Tolvane desktop app stores its settings, sign-in session and library on your computer using local storage. Our payment provider Paddle may set its own cookies on its checkout pages, governed by Paddle's policies.
